These terms govern your use of Landscapr, a garden design application operated by FarmLab ("we", "us" or "our"). By creating an account or using the service, you agree to be bound by these terms. If you do not agree, please do not use the service.
1. The service
Landscapr lets you plan gardens on a scale grid, place features and plants, view designs in 2D and 3D, generate a shopping list and use an AI garden design assistant. The service is provided for personal, non-commercial garden planning unless you have a separate commercial agreement with us.
2. Your account
You must be at least 13 years old to create an account. You are responsible for keeping your login details secure and for all activity under your account. Tell us promptly if you suspect any unauthorised use. We may suspend or close accounts that breach these terms.
3. Acceptable use
You agree not to misuse the service, including not to: upload content that is unlawful, harmful, defamatory or infringes someone else's rights; attempt to access data that is not yours; interfere with the service's security; or use automated tools to scrape or overload the service. Designs you create are your content; you are responsible for their accuracy and lawfulness.
4. Your content and how we use your data
You retain ownership of the gardens and designs you create ("your content"). You grant us a licence to host, store, display and process your content solely to operate and improve the service for you, including rendering your plans and generating your shopping lists.
We may use aggregated, de-identified or anonymised data derived from use of the service to improve features, train and refine our AI garden design assistant, and produce analytics. We will not sell your personal data or your individual garden designs to third parties. Sharing a garden via a public link makes that plan viewable by anyone who has the link; you control this setting and can turn it off at any time.

5. AI-generated designs
Designs suggested by the AI garden design assistant are generated automatically and may not suit your climate, soil, council rules or site conditions. Treat them as a starting point. You are responsible for checking that any planting or structure is appropriate and lawful for your location before building or planting.
6. Intellectual property
Landscapr, its branding, the plant and feature catalogues and the software are owned by us or our licensors and protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable licence to use the service for your own garden planning. You may not copy, redistribute or reverse-engineer the service.
7. Third-party links and retailers
The service may link to third-party retailers and external sites. We are not responsible for their content, pricing, availability or practices. Any dealings with third parties are between you and them.
8. Disclaimers
The service is provided "as is" without warranties of any kind. We do not promise the service will be uninterrupted, error-free or that your designs will grow as planned. Gardening outcomes depend on many factors outside our control.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential losses arising from your use of the service. Our total liability for any claim is limited to the amount you have paid us in the 12 months before the claim, or AUD $100, whichever is greater.
10. Indemnity
You agree to indemnify us against claims arising from your content or your breach of these terms.
11. Termination
You may close your account at any time. We may suspend or terminate your access if you breach these terms. On termination, your right to use the service ends; we may delete your data in line with our retention policy.
12. Changes to these terms
We may update these terms from time to time. If we make material changes, we will notify you through the service or by email. Continued use after the changes take effect means you accept the updated terms. The version and date above show the current terms.
13. Governing law
These terms are governed by the laws of New South Wales, Australia. Any dispute is submitted to the courts of that jurisdiction.
